Terms of Service

These Terms of Service ("Terms") govern your use of all products and services provided by The Fair Company ("Fair," "we," "us," or "our"), including all products accessible at tryfair.ai, faircompany.ai, and any fair*.ai domain. By creating an account or using any Fair product, you agree to these Terms.

1. Your Account

One Fair account gives you access to all Fair products. You are responsible for maintaining the security of your account credentials. You must provide accurate information when creating your account.

You may connect third-party accounts (Google, Microsoft, social media platforms) to enable product features. You are responsible for complying with those platforms' terms of service. You can disconnect any connected account at any time.

2. Your Content

You own everything you create, upload, or store on Fair. We do not claim any intellectual property rights over your content. You grant us a limited license to store, process, and display your content solely to provide the services you use.

You are responsible for the content you create and share through Fair products. You must not use Fair to store or distribute content that is illegal, harmful, or violates the rights of others.

3. Pricing and Billing

Pay-Per-Use

Fair products use pay-per-use pricing. You are charged per action at published rates. There are no monthly subscriptions, no annual contracts, and no feature tiers. All features are available from your first use.

Wallet

You prepay by adding funds to your Fair wallet. Your balance is shared across all Fair products. Wallet balances do not expire. The minimum top-up is $5.00 USD.

Pricing Changes

We may change our per-action pricing. Price changes will be announced at least 30 days in advance and will not apply to actions already completed. Current prices are always displayed on each product's pricing page and at faircompany.ai/pricing.

Refunds

Unused wallet balance is refundable upon request. Charges for completed actions are non-refundable, as the underlying infrastructure cost has already been incurred. If you believe you were charged incorrectly, contact billing@faircompany.ai.

4. Acceptable Use

You agree not to:

• Use Fair products to send spam, phishing, or unsolicited bulk communications.
• Attempt to access other users' accounts or data.
• Use automated means to abuse rate limits or circumvent usage metering.
• Use Fair products to store or distribute malware, illegal content, or content that violates third-party rights.
• Resell Fair services without our written permission.
• Reverse engineer, decompile, or attempt to extract source code from Fair products.

We may suspend or terminate accounts that violate these terms. We will provide notice and an opportunity to export your data before permanent termination, except in cases of severe abuse.

5. Third-Party Integrations

Fair products integrate with third-party services (Google, Microsoft, Stripe, social media platforms, etc.). These integrations are governed by the respective third-party terms. We are not responsible for the availability, accuracy, or policies of third-party services.

When you connect a third-party account, you authorize Fair to access and use data from that account as described in our Privacy Policy. You can revoke this access at any time by disconnecting the account in your Fair product settings or in the third-party service's settings.

6. Service Availability

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, deploy updates, or experience outages. We will communicate scheduled maintenance in advance when possible.

Fair is provided "as is." We do not warrant that it will meet your specific requirements, be error-free, or be available at all times. For critical business processes, maintain your own backups.

7. Data Portability

You can export your data at any time in standard formats (CSV, JSON) from within each product. We do not charge for data export. There are no lock-in mechanisms, export fees, or artificial barriers to leaving.

8. Account Termination

By You

You can delete your account at any time. Account deletion permanently removes all your data within 30 days. Unused wallet balance will be refunded to your original payment method.

By Us

We may terminate your account for violation of these Terms, non-payment, or extended inactivity (12+ months with no usage). Before termination for inactivity, we will send at least two email notices over 30 days. You will have the opportunity to export your data before deletion.

9. Limitation of Liability

To the maximum extent permitted by law, Fair's total liability to you for any claims arising from your use of our products is limited to the amount you paid to Fair in the 12 months preceding the claim.

Fair is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, even if we were advised of the possibility of such damages.

10. Indemnification

You agree to indemnify and hold Fair harmless from any claims, damages, or expenses arising from your use of our products, your content, or your violation of these Terms.

11. Intellectual Property

Fair, the Fair logo, and all Fair product names (FairCRM, FairCal, FairSign, etc.) are trademarks of The Fair Company. The software, design, and documentation are copyrighted. These Terms do not grant you any rights to use our trademarks or intellectual property except as needed to use the products.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions. Any disputes will be resolved in the courts of Delaware.

13. Changes to These Terms

We may update these Terms as our products evolve. Material changes will be communicated via email or in-product notification at least 30 days in advance. Continued use of Fair after changes take effect constitutes acceptance.
